Duty of Candour Report 2021

The purpose of the duty of candour procedure is to support the implementation of consistent responses when there has been an incident that has resulted in unintended or unexpected harm that is not related to the course of the condition for which the person is receiving care. To ensure that myCare consistency apply the duty of candour procedure, it is important that unintended or unexpected incidents triggering the duty of candour procedure are monitored, recorded, and reported.

The duty of candour procedure can be aligned with adverse events / incidents, case reviews, notifications, complaints / disclosures through relevant ‘whistleblowing’ mechanisms. These processes are well established within myCare, and our reporting includes information regarding how we have met the various steps within the duty of candour procedure and what we have learnt from the review and how the learning has been shared.

The primary purpose of our annual report is:

  • to demonstrate learning which has taken place following the harm being identified.
  • to provide public assurance that the duty of candour is being embedded in the sectors to which it applies.
  • to encourage responsible persons to self-reflect on how the duty is being embedded and how the quality of operation can be continually improved.
  • to contribute to the Care Inspectorate’s, Healthcare Improvement Scotland’s and the Scottish Government’s wide evidence base about the provision of social care and health services.
